These terms apply to every booking with The Joy Is Reel, wedding content creator, Unit 4, Wassage Way, Lovett Rd, Droitwich WR9 0NX.
1. Definitions
“Agreement” means these terms and conditions together with the Order.
“Order” means the booking placed by the Client, by accepting a quote or package from The Joy Is Reel, for the supply of the Services.
“Client” means the couple, or the person booking on their behalf, named in the Order.
“Services” means the wedding content creation services specified in the Order, including attendance at the wedding and the supply of the Content.
“Content” means the edited highlight videos, short-form clips and raw footage to be supplied by The Joy Is Reel, as specified in the Order.
“Party” means either the Client or The Joy Is Reel.
2. Structure of this Agreement
2.1 The Order is accepted on the earlier of the Client paying the deposit set out in the Order, or any act by The Joy Is Reel at the Client’s request consistent with fulfilling the Order. That date is the “Commencement Date”.
2.2 These terms apply to the Order to the exclusion of any other terms the Client seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
2.3 If there is any conflict between different parts of this Agreement, the terms of the Order take precedence over these terms and conditions.
3. Commencement and Term
This Agreement comes into effect on the Commencement Date and continues until the Services are completed and the Content has been delivered.
4. Our Services
4.1 The Joy Is Reel will perform the Services with reasonable care and skill, ensure the Services match the package described in the Order, and provide the Services in line with all applicable laws and regulations.
4.2 Creative judgement. The Joy Is Reel decides what to film, how to film it and how to edit it. We will follow the Client’s reasonable requests where we can, but we cannot guarantee that any particular moment, person or shot will be captured.
4.3 What the service is. The Services are social-first wedding content filmed on mobile phones. They are not a wedding film and do not replace a photographer or a videographer.
4.4 Coverage. We film the parts of the day included in the package set out in the Order. Coverage outside the package must be agreed in writing before the wedding day.
4.5 Staff. The Joy Is Reel is responsible for the conduct of everyone it sends to perform the Services.
4.6 Illness and backup. If the person due to attend is unwell or otherwise unable to attend, the other founder or a suitable replacement content creator will attend instead. We carry more than one phone to every wedding.
4.7 Health and safety. The Joy Is Reel may decline to carry out or continue the Services and terminate this Agreement under clause 10 if, in its opinion, continuing would put the health, safety or welfare of any of its people at risk, or if any of them is subject to threatening or abusive behaviour from the Client or anyone associated with the Client.
5. Delivery of Content
5.1 Edited highlight videos are delivered within 48 hours of the wedding day. Where the Order includes The Grand Experience, one edited highlight video is delivered within 24 hours.
5.2 Raw footage is delivered by a download link through Dropbox or WeTransfer. The link stays live for 28 days from the date it is sent. The Client is responsible for downloading and backing up the Content within that time. The Joy Is Reel is not obliged to keep any Content after the 28 days.
5.3 The edited highlight videos are supplied as final. Re-edits are not included unless agreed in the Order.
6. The Client’s Duties
6.1 The Client will provide, in good time, all information The Joy Is Reel reasonably needs, including the venue addresses, the timings of the day and a contact on the day.
6.2 Venue and permissions. The Client is responsible for checking that the venue, the officiant and any church or registrar allow filming, and for telling The Joy Is Reel about any restrictions. The Joy Is Reel is not liable for Content that could not be captured because filming was restricted.
6.3 Other suppliers. The Client will tell their photographer and any videographer that a content creator has been booked. We work alongside them and around their shots.
6.4 Guests. The Client is responsible for letting guests know that filming will take place.
6.5 Access. The Client will arrange reasonable access to the venue and to each part of the day covered by the package.
6.6 Meals. A supplier meal is appreciated on longer bookings but is not a condition of this Agreement.
7. Payment
7.1 Deposit. A non-refundable deposit of 25% of the total fee is payable to confirm the booking. The date is not held until the deposit has been received.
7.2 Second payment. 50% of the total fee is payable six months before the wedding day.
7.3 Final payment. The remaining 25% is payable no later than 28 days before the wedding day.
7.4 Late bookings. If the booking is made after a payment date has passed, the payments already due are payable on booking.
7.5 Payment may be made by bank transfer using the details on the invoice.
7.6 Travel. Travel to venues within 20 miles of our base in Droitwich is included. Travel to venues further away is quoted according to the location and shown in the Order before the Client confirms the booking.
7.7 Late payment. If any sum remains unpaid after it is due, The Joy Is Reel may terminate the Order immediately, in which case payments already received remain non-refundable, and may charge interest at 4% per annum above the Lloyds base rate until payment is made in full.
7.8 Cancellation by the Client. The deposit and any part payments are non-refundable once paid. Save where clause 12 applies, if the Client cancels or the wedding does not go ahead, no refunds will be issued.
8. Ownership and Use of Content
8.1 The Joy Is Reel owns the copyright in the Content. The Client is given a permanent, personal licence to use, share and post the Content for non-commercial purposes.
8.2 The Client may not sell the Content or allow it to be used commercially by a third party without The Joy Is Reel’s written consent.
8.3 The Joy Is Reel may use clips from the wedding on its website and social media to promote its services. If the Client would rather their Content stayed private, they can tell us in writing at any time and we will not use it.
8.4 Nothing in this Agreement gives the Client the right to use The Joy Is Reel’s name, logo or other intellectual property without written consent.
9. Liability
9.1 This clause sets out the entire liability of The Joy Is Reel, whether in contract, tort (including negligence) or otherwise.
9.2 The Joy Is Reel does not exclude liability for personal injury or death resulting from its acts or omissions, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law. Nothing in this Agreement affects the Client’s statutory rights as a consumer.
9.3 Subject to clause 9.2, total liability shall not exceed the total fees payable under this Agreement.
9.4 Subject to clause 9.2, The Joy Is Reel shall not be liable for events outside its reasonable control, for moments missed because of changes to the timings of the day, restrictions on filming, or the actions of guests or other suppliers, or for any economic or business loss.
10. Termination
10.1 Either Party may terminate this Agreement immediately by written notice if the other Party commits a material default that cannot be remedied, or commits a default and fails to remedy it within fourteen (14) days of written notice.
10.2 If The Joy Is Reel terminates under clause 10.1, no refunds shall be due.
10.3 Termination does not affect rights that have already accrued, and clauses intended to survive termination remain in effect.
11. Consequences of Termination
On termination, rights already accrued remain enforceable and the Client must pay all fees that are due and unpaid.
12. Force Majeure
Neither Party shall be liable for delay or failure caused by events beyond its reasonable control, including act of God, war, civil unrest, strike, trade dispute, breakdown, accident or any similar unforeseen event. The affected Party shall be entitled to a reasonable extension of time.
13. Sub-Contracting
The Joy Is Reel may delegate or subcontract its duties, for example to a replacement content creator under clause 4.6. The Joy Is Reel remains fully responsible for the acts and omissions of anyone it subcontracts to.
14. General
14.1 Severability. If any term is found to be invalid or unenforceable, it shall be severed and the remaining terms shall stay in full force.
14.2 Third parties. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term.
14.3 Waiver. Delay or failure to exercise a right is not a waiver of that right.
14.4 Entire agreement. This Agreement is the entire agreement between the Parties and supersedes all earlier written or oral agreements.
14.5 Governing law. This Agreement is governed by the law of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales.
